事实认定

事实认定（fact-finding），是指在刑事诉讼或民事诉讼等诉讼程序中，通过当事人的举证、相互质证等阶段，最终由法官和陪审团确定案件事实的过程。通过事实认定过程，确定的事实将作为判决的主要依据和基础。
