仲裁

仲裁是当事人合意选择的替代性争议解决方式（ADR）的一种。也就是處理現在或將來會有的爭議。当事人选择并授权非司法机构或个人对其提交的爭議作出具有约束力的裁判。

強制仲裁
強制仲裁，則是當事人本可提起訴訟，但法律規定須以仲裁方式解決紛爭，強制當事人僅可仲裁、不得提起訴訟。中華民國臺灣自由地區《證券交易法》166條有規定強制仲裁。中華民國政府《採購法》85條之1是否為強制仲裁，則有爭議。有主張其僅為法律規定之「法定仲裁」，因政府機關並無獨立法人格，對外私法契約之法律主體仍為國家或地方政府等「公法人」本身，並非各「機關」，所以不能說是「強制」機關須用仲裁解決爭議，而是國家預先同意各級機關以仲裁方式解決爭議之「法定仲裁」。
