法律经济学

法律經濟學（law and economics）或稱法律的經濟分析（economic analysis of law），是由美國學者在1960年代發展出的跨領域交叉學科。主要是以經濟學的效率觀點，分析法律的形成、架構、與運作方式，法律與司法制度對社會的經濟效益影響。1960年，芝加哥大学教授罗纳德·科斯發表了「社會成本問題」(The Problem of Social Cost)，此論文提出後人所稱的科斯定理，被視為是法律經濟學的奠基之作。

法律经济学在汉语法学界
法律经济学在臺灣
臺灣在法律經濟學的領域方興未艾，此一領域比較知名的學者，如熊秉元著有《法律經濟學開講》和《正義的效益：一場法學與經濟學的思辨之旅》、王文宇著有《民商法理論與經濟分析》系列著作、簡資修著有《經濟推理與法律》，以及謝哲勝著有《法律經濟學》，為較知名之著作。

法律经济学在中国大陆
法律经济学从1980年代中期开始在大陆出现，至今方兴未艾。这个领域比较知名的学者有北京大学法学院教授朱苏力、武漢大學教授漆多俊、浙江大学教授钱弘道、中国海洋大学教授桑本谦、中山大学教授周林彬、山东大学教授魏建、厦门大学教授龙小宁等。大陆经济学界也不乏有法律经济学的研究者，比较知名的包括浙江大学教授史晋川、山东大学教授乔岳等。

法律经济学在香港
許多香港的法律和經濟學研究與新制度經濟學有關。這些文章中有很多是由新制度經濟學家撰寫的。例如Li(2012)提出從過去20年的香港法律報告的資料顯示, 自從第一起案件以來，滲水法庭案件的數量從1994年起增加了40倍 。賠償總額也大大增加。但是，居民向法庭尋求賠償的案件比噪音污染少得多。這可能反映了高昂的交易成本 。
